Terms of Service
These Terms govern your use of the AnswerVista website and services (the “Services”), provided by Uwe Morawetz (“we”, “us”). By purchasing or using the Services you agree to these Terms.
1. What we provide
AnswerVista measures and helps improve how a brand appears in AI answer engines (such as ChatGPT, Perplexity and Google’s AI Overviews) and traditional search. Services include one-time audits, implementation work, and monthly monitoring/optimization retainers, as described on our site at the time of purchase.
2. No guaranteed results
We do not and cannot guarantee any specific AI ranking, citation, visibility, traffic or revenue outcome. AI answer engines and search engines are operated by third parties, change frequently, and produce non-deterministic results outside our control. We provide the work and report leading indicators based on transparent methodology; we make no warranty as to outcomes. Any forecasts or examples are illustrative, not promises.
3. Orders, prices and payment
Prices are shown on our site and may change for future orders. Payment is collected by Paddle.com Market Limited, which acts as the Merchant of Record (the reseller and seller of record) for purchases. Paddle handles billing, payment, and applicable sales tax/VAT, and its buyer terms also apply to the transaction.
4. Subscriptions and term
Monitoring retainers are monthly subscriptions billed in advance, with a minimum term of 3 months. After the minimum term you may cancel at any time, effective at the end of the current billing period. Annual prepayment, where offered, runs for the prepaid term. We may pause or stop providing a Service for non-payment.
5. Your responsibilities
You confirm you are authorised to request analysis of, and changes to, the domain(s) and content you submit. You are responsible for implementing recommendations on your own systems unless we are explicitly engaged to do so. You will not use the Services unlawfully or to infringe others’ rights.
6. Acceptable use
You agree not to use the Services to break the law, infringe intellectual-property or privacy rights, send spam, deceptively manipulate third-party platforms, or interfere with the operation or security of the Services. We may suspend access for breach of this section.
7. Deliverables and intellectual property
On full payment, you receive a licence to use the reports, content and assets we deliver to you for your own business. We retain ownership of our methods, templates, and know-how. You may not resell our Services as your own without a written reseller agreement.
8. Liability
To the maximum extent permitted by law, our total liability arising out of the Services is limited to the amount you paid for the specific Service giving rise to the claim. We are not liable for indirect or consequential losses, lost profits, or third-party engine behaviour. Nothing limits liability that cannot be limited by law (including for intent or gross negligence, or injury to life, body or health).
9. Termination
You may stop using the Services and cancel subscriptions as set out in our Refund & Cancellation Policy. We may suspend or terminate the Services for material breach of these Terms or for non-payment. Provisions that by their nature should survive termination (e.g. intellectual property, liability, governing law) continue to apply.
10. Changes and governing law
We may update these Terms; the version in force at your time of purchase applies to that purchase. These Terms are governed by the law of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rights of your country of residence remain unaffected.
Privacy Notice
This notice explains how we process personal data under the EU General Data Protection Regulation (GDPR).
1. Controller
Uwe Morawetz · Untergründemich 40 · 51491 Overath · Germany · support@answervista.com
2. What we process and why
- Contact & account data (name, business email, company, the domain you ask us to analyse, messages) — to respond to enquiries and perform our contract with you. Legal basis: Art. 6(1)(b) GDPR (contract) and 6(1)(f) (legitimate interest in communicating with prospects and clients).
- Service data (publicly available information about your website and how AI engines answer about it). Legal basis: Art. 6(1)(b)/(f) GDPR.
- Payment data — collected and processed by Paddle as Merchant of Record. We do not receive or store full card details; we receive transaction confirmations. Legal basis: Art. 6(1)(b) GDPR.
- Outreach data — where we contact a business prospect by email, we process business contact data on the basis of legitimate interest (Art. 6(1)(f) GDPR). You can opt out at any time by replying “stop”, and we will suppress your address.
3. Processors and recipients
We use carefully selected service providers acting on our instructions, including: Paddle (payments/MoR), Vercel (website hosting), Resend and Google Workspace (email), and tooling used to run and measure our outreach and audits. Some providers may process data outside the EU/EEA under appropriate safeguards (e.g. EU Standard Contractual Clauses).
4. Retention
We keep personal data only as long as needed for the purposes above or as required by law (e.g. tax retention periods), then delete or anonymise it.
5. Your rights
You have the right to access, rectification, erasure, restriction, data portability, and to object to processing based on legitimate interest. Where we rely on consent, you may withdraw it at any time. You may lodge a complaint with a supervisory authority (in Germany, the data-protection authority of your or our state). To exercise any right, email support@answervista.com.
6. Cookies
Our website itself sets no marketing or analytics cookies. When you start a checkout, our payment provider Paddle sets cookies that are strictly necessary to process the transaction and to help prevent fraud. You can control cookies through your browser settings; blocking strictly necessary cookies may prevent the checkout from working.
7. Security & international transfers
We use appropriate technical and organisational measures to protect personal data against loss, misuse and unauthorised access. Some of our processors are located outside the EU/EEA; where that is the case, transfers are safeguarded by mechanisms such as the EU Standard Contractual Clauses or an EU adequacy decision.
8. Changes
We may update this notice from time to time. The current version is always available on this page with its “last updated” date above.
Refund & Cancellation Policy
1. Digital services
Our Services are digital and often delivered immediately or within a few business days. Where you ask us to begin (e.g. to produce and deliver a digital audit report) you acknowledge that performance starts right away and, to the extent permitted by law, your statutory right of withdrawal for digital content ends once delivery has begun with your consent.
2. One-time audits and implementation
Because a delivered audit/report is a completed digital good, it is generally non-refundable once delivered. If something is genuinely wrong with what we delivered, contact us within 14 days and we will correct it or, at our discretion, offer a partial or full refund.
3. Subscriptions
You may cancel a monitoring subscription at any time after the 3-month minimum term; cancellation takes effect at the end of the current billing period and you retain access until then. We do not provide partial refunds for the current period. Annual prepayments are non-refundable for the remaining prepaid period except where required by law.
4. How to request
Email support@answervista.com with your order details. As Merchant of Record, Paddle processes approved refunds back to your original payment method; Paddle’s buyer terms also apply. Your mandatory statutory rights as a consumer remain unaffected.
